{"id":1658,"date":"2026-07-27T13:45:46","date_gmt":"2026-07-27T03:45:46","guid":{"rendered":"https:\/\/www.abkj.com.au\/articles\/?p=1658"},"modified":"2026-07-27T13:45:46","modified_gmt":"2026-07-27T03:45:46","slug":"remedial-action-notice-body-corporate-queensland","status":"publish","type":"post","link":"https:\/\/www.abkj.com.au\/articles\/remedial-action-notice-body-corporate-queensland\/","title":{"rendered":"When Can a Body Corporate Issue a Remedial Action Notice to a Caretaker?"},"content":{"rendered":"<p>Disputes over caretaker performance often begin with recurring concerns about cleaning, gardening, pool care, routine maintenance or the reporting of defects. If those concerns remain unresolved, a <a href=\"https:\/\/www.abkj.com.au\/body-corporate-lawyers.html\">body corporate<\/a> may consider issuing a Remedial Action Notice, commonly referred to as a RAN.<\/p>\n<p>A RAN is not simply a formal letter of complaint. It is part of a statutory process which may ultimately lead to the termination of the caretaker\u2019s engagement. Bodies corporate should therefore proceed carefully before issuing one.<\/p>\n<h2>When can a RAN be issued?<\/h2>\n<p>The caretaker\u2019s duties will usually be set out in a written caretaking agreement between the body corporate and the caretaker. The agreement may include detailed schedules specifying the work to be performed, how often it must be done and the standard required.<\/p>\n<p>Caretaking agreements are also governed by the <a href=\"https:\/\/www.legislation.qld.gov.au\/view\/html\/inforce\/current\/act-1997-028\">Body Corporate and Community Management Act 1997<\/a> and the regulation module applying to the particular scheme.<\/p>\n<p>The legislation generally allows a body corporate to issue a RAN in circumstances including where a caretaker:<\/p>\n<p>engages in misconduct or is grossly negligent in performing its functions;<br \/>\nfails to carry out duties under the caretaking agreement; or<br \/>\ncontravenes an applicable code of conduct.<\/p>\n<p>For example, the process is set out in reg 152 of the Body Corporate and Community Management (Standard Module) Regulation 2020. The other regulation modules contain corresponding provisions.<br \/>\nA RAN will commonly arise after performance concerns have already been raised with the caretaker and have not been resolved. It should not ordinarily be the first communication the caretaker receives about the issue.<\/p>\n<h2>Start with the caretaking agreement<\/h2>\n<p>The first question is not simply whether the committee is dissatisfied with the caretaker\u2019s performance.<\/p>\n<p>The body corporate should ask:<br \/>\nWhat duty was the caretaker required to perform, and what evidence shows that the duty was not performed?<\/p>\n<p>Every caretaking agreement is different. Some agreements contain detailed schedules stating exactly what must be done and how often. Others impose broader duties concerning the cleanliness, presentation or maintenance of common property.<\/p>\n<p>For example, a general complaint that the gardens are untidy may not be enough. The body corporate may need to identify:<\/p>\n<ul>\n<li>the affected area;<\/li>\n<li>the condition complained of;<\/li>\n<li>when the issue was observed;<\/li>\n<li>the duty the caretaker was required to perform; and<\/li>\n<li>what the caretaker failed to do.<\/li>\n<\/ul>\n<p>Not every complaint about the operation of a scheme is capable of supporting a RAN. The relevant task may be the responsibility of the body corporate, another contractor or a lot owner rather than the caretaker. The body corporate should therefore focus on the alleged breaches which can be most clearly connected to an identified duty and supported by evidence, rather than including every complaint that has been raised about the caretaker.<br \/>\nA body corporate also cannot use a RAN to impose new duties or expand the caretaker\u2019s obligations beyond the terms of the agreement and applicable legislation.<\/p>\n<p>Contact our body corporate law team on (07) 5532 3199 or <a class=\"underline underline underline-offset-2 decoration-1 decoration-current\/40 hover:decoration-current focus:decoration-current\" href=\"https:\/\/www.abkj.com.au\/contact-us.html\">submit an enquiry online<\/a> for tailored advice.<\/p>\n<h2>Gather the Evidence<\/h2>\n<p>Before issuing a RAN, the body corporate should ordinarily raise its concerns with the caretaker in writing and give the caretaker an opportunity to respond.<\/p>\n<p>The caretaker\u2019s response may identify that:<\/p>\n<ul>\n<li>the work has already been performed;<\/li>\n<li>the caretaker disputes that the work falls within its duties;<\/li>\n<li>circumstances outside the caretaker\u2019s control prevented the work from being completed;<\/li>\n<li>the complaint can be resolved without formal action; or<\/li>\n<li>further evidence is required.<\/li>\n<\/ul>\n<p>Depending on the issue, the relevant evidence may include dated photographs, inspection records, correspondence, maintenance schedules, contractor reports or independent expert reports.<\/p>\n<p>A lengthy list of complaints does not necessarily make a stronger RAN. Weak, vague or unsupported allegations may instead distract from genuine breaches and undermine the body corporate\u2019s position.<\/p>\n<h2>What Must a RAN Contain?<\/h2>\n<p>A RAN must give the caretaker enough information to understand the alleged failure and what must be done to remedy it.<\/p>\n<p>Under the applicable regulation module, the notice must:<\/p>\n<ul>\n<li>identify the alleged misconduct, gross negligence, unperformed duty or contravention of the applicable code or regulation module;<\/li>\n<li>provide sufficient details of the conduct or duty concerned;<\/li>\n<li>require the caretaker to remedy the issue within the stated period;<\/li>\n<li>allow at least 14 days after the notice is given for compliance; and<\/li>\n<li>warn that the body corporate may terminate the engagement or authorisation if the notice is not complied with.<\/li>\n<\/ul>\n<p>Although 14 days is the statutory minimum, it may not be a reasonable period in every case. The time allowed should take account of the nature and extent of the work required and whether contractors, materials or specialist assistance are needed.<\/p>\n<p>The notice should also address each alleged breach separately. The clearer the notice, the easier it will be to determine whether the caretaker has complied.<\/p>\n<h2>What Happens After the RAN is Issued?<\/h2>\n<p>The caretaker may respond by disputing the allegations, providing evidence that the duties were performed or carrying out the work required by the notice.<\/p>\n<p>The body corporate should then assess each alleged breach and the caretaker\u2019s response objectively. A RAN is intended to give the caretaker a genuine opportunity to remedy the identified issue. It should not be issued merely to complete a procedural step towards a termination which has already been decided upon.<\/p>\n<p>If the caretaker complies with the notice, the body corporate will not have a right to terminate under that RAN.<\/p>\n<p>If the caretaker does not comply, termination is still not automatic. The body corporate must approve the termination by ordinary resolution at a general meeting, with the motion decided by secret ballot. The final decision cannot be made by the committee alone.<\/p>\n<p>Where the caretaking agreement is a financed contract, additional considerations apply. The body corporate must give the financier written notice that it has a right to terminate the agreement and allow at least 21 days to pass before terminating. In that time, the financier can, and one would expect that it would, step in to take possession of the management rights and exercise power of sale to sell the management rights to a third party. Depending on the circumstances, the caretaker may seek orders restraining or setting aside the termination, together with damages or other relief.<\/p>\n<p>The decision in <i>Linali Pty Ltd as trustee for the Chakra Family Trust v Body Corporate for Crown CTS 41282<\/i> [2024] QCAT 446 demonstrates the risks of issuing defective notices or terminating prematurely.<\/p>\n<p>QCAT found that the body corporate had improperly terminated the caretaking and letting agreements. The notices included significant defects, and the general meeting resolution to terminate was found to be unreasonable. The caretaker was awarded $311,958 in damages.<\/p>\n<p>The decision shows that a RAN may later be examined closely to determine whether:<\/p>\n<ul>\n<li>the notice complied with the applicable regulation module;<\/li>\n<li>the alleged breaches were established;<\/li>\n<li>the caretaker was given a proper opportunity to remedy them;<\/li>\n<li>the caretaker failed to comply; and<\/li>\n<li>the body corporate <a href=\"https:\/\/www.abkj.com.au\/articles\/tests-for-reasonableness-of-body-corporate-decisions\/\">acted reasonably<\/a> in deciding to terminate.<\/li>\n<\/ul>\n<h2>Is a RAN Always Required Before Termination?<\/h2>\n<p>No. Although a RAN is the usual pathway where a body corporate is seeking to address remediable performance failures, it is not the only possible basis for terminating a caretaking or letting arrangement.<\/p>\n<p>Depending on the circumstances, an arrangement may also be terminated under the body corporate legislation, by agreement between the parties or under an express right contained in the engagement or authorisation.<\/p>\n<p>Those pathways involve different grounds and procedural requirements. A body corporate should obtain advice about the available termination process before taking formal action.<\/p>\n<h2>What Should a Body Corporate Do?<\/h2>\n<p>Before issuing a RAN, a body corporate should:<\/p>\n<ul>\n<li>review the caretaking agreement and applicable regulation module;<\/li>\n<li>identify the particular duties said to have been breached;<\/li>\n<li>gather clear evidence of each alleged failure;<\/li>\n<li>raise the concerns with the caretaker and consider any response;<\/li>\n<li>determine what the caretaker must reasonably do to remedy the issue; and<\/li>\n<li>obtain advice before issuing the notice or proposing termination.<\/li>\n<\/ul>\n<p>Caretaker disputes can become costly and disruptive for everyone involved in a scheme. Early and precise communication may allow genuine performance concerns to be resolved before the relationship deteriorates further.<\/p>\n<p>Where formal action is necessary, careful preparation is essential.
