{"id":85,"date":"2015-07-01T03:37:00","date_gmt":"2015-07-01T03:37:00","guid":{"rendered":"http:\/\/dev2.e-cbd.com\/abkj\/articles\/?p=85"},"modified":"2024-09-25T13:18:38","modified_gmt":"2024-09-25T03:18:38","slug":"who-gets-the-children","status":"publish","type":"post","link":"https:\/\/www.abkj.com.au\/articles\/who-gets-the-children\/","title":{"rendered":"Who Gets The Children?"},"content":{"rendered":"<p>It is a long standing misconception in matters relating to children, that the mother will automatically get full \u2018<strong>parental responsibility<\/strong>\u2019 (e.g. custody of the children).<\/p>\n<p>This is not entirely correct.<\/p>\n<h2>Parental Responsibility<\/h2>\n<p>Part VII of the <em>Family Law Act <\/em>entitled \u2018Children\u2019 sets out a number of \u2018objects\u2019 which are to ensure the best interests of the child are met.\u00a0 These objects include:<\/p>\n<ol>\n<li>Ensuring that the children have the benefit of both their parents having a meaningful involvement in their lives to the maximum extent consistent with the best interests of the child; and<\/li>\n<li>Protecting children from physical or psychological harm by being subject to or exposed to abuse, neglect and\/or family violence; and<\/li>\n<li>Ensuring that children receive adequate and proper parenting to help them achieve their full potential; and<\/li>\n<li>Ensuring that parents fulfill their duties and meet their responsibilities concerning the core welfare and development of the children.<\/li>\n<\/ol>\n<p>The principles underlying those objects are described in the <em>Family Law Act<\/em> as:<\/p>\n<ol>\n<li>Children have the right to know and be cared for by both parents, regardless of whether their parents are married, separated, have never been married or have never lived together; and<\/li>\n<li>Children have a right to spend time on a regular basis and communicate on a regular basis with both their parents and other people significant to their care, welfare and development (such as grandparents and other relatives); and<\/li>\n<li>\u00a0Parents jointly share duties and responsibilities concerning the care, welfare and development of their children; and<\/li>\n<li>Parents should agree about the future parenting of their child together; and<\/li>\n<li>Children have a right to enjoy their culture (including the right to enjoy that culture with other people who share that culture).<\/li>\n<\/ol>\n<p>Whilst there is a presumption under the <em>Family Law Act<\/em> that parents have equal shared parental responsibility, this presumption does not apply when there are reasonable grounds to believe that a parent or a person who lives with a parent has engaged in the abuse of the child or another child who at the time was a member of the parent\u2019s family, or family violence.<\/p>\n<p>There are many cases in favour of shared responsibility and rulings against the presumption of shared responsibility.\u00a0 For a more detailed analysis of your circumstances, please <a href=\"https:\/\/www.abkj.com.au\/contact-us.html\">contact our office<\/a>.<\/p>\n<p>Important: This section of the Family Law Act has recently underdone major changes. Please view our articles below for more up to date information:<\/p>\n<p class=\"entry-title float-right\"><a href=\"https:\/\/www.abkj.com.au\/articles\/family-law-removal-of-the-parenting-pathway\/\">Removal of the Parenting Pathway<\/a><\/p>\n<p class=\"entry-title float-right\"><a href=\"https:\/\/www.abkj.com.au\/articles\/changes-to-family-law-best-interests-of-the-child\/\">Changes to Family Law \u2013 Best Interests of the Child<\/a><\/p>\n<h2><strong>Who does the child live with?<\/strong><\/h2>\n<p>The <em>Family Law Act <\/em>requires the Court to consider the practicality of the child spending equal time with each of the parents.
